Cookie Law, a chi mando la fattura?

Come ha scritto anche Gianluca, la normativa sui cookie è un problema che finirà per daneggiare il piccolo editore/azienda senza risolvere la questione della tutela della privacy nei confronti delle grandi corporation. Se si applica alla lettera la normativa, come ben spiegato su CheFuturo da Ernesto Bellisario, dobbiamo non solo dare l’informativa ma attivare una serie di strumenti che consentano al nostro visitatore di decidere quali cookie accettare e quali no. Molti siti come questo fanno uso di wordpress e di piattaforme di content management e chi più, chi meno installano plugin per diversi scopi. Molti di questi plugin, come ad esempio Analytics by Yoast, usano i cookies di google per le statistiche. Ora, in linea teorica, noi saremo tenuti non solo a dire che si utilizzano i cookie di google, ma dovremo dare la possibilità preventiva (ciòè prima che vengano installati) all’utente di decidere se utilizzarli o meno. Questo significa, operativamente, ad andare a inserire una serie di controlli all’interno di ciascun plugin in modo tale che crei il cookie solo dopo che l’utente abbia dato il consenso. Chi lavora con i plugin sa benissimo che, una volta che questo viene aggiornato (magari per la correzione di qualche bug), tutte le modifiche precedentemente apportate vengono cancellate. Quindi, in teoria, dovremo nuovamente mettere mano al plugin e ridefinire i controlli; o rinunciare all’aggiornamento magari critico per la sicurezza del sito; o, ancora, rinunciare all’utilizzo di quel plugin e crearci delle funzioni ad hoc. E già qui perderemo l’80% dei siti attualmente on-line. Ora, se si tratta di una grande azienda, l’impatto di un tale intervento è oneroso ma sostenibile in ottica di business. Ma cosa succede se si tratta del blogger singolo o del piccolo imprenditore che, ad esempio, utilizza il login di facebook per i commenti? I costi che si devono sostenere non sono solo quelli tecnici (che già sarebbero sufficienti), ma anche quelli legali perché le sanzioni previste per la mancata o l’incompleta applicazione della normativa sono esorbitanti: per i casi di omessa o incompleta informativa la sanzione prevista è da 6 mila a 36 mila euro l’installazione di cookie sui terminali degli utenti in assenza del preventivo consenso degli stessi comporta la sanzione del pagamento di una somma da 10 a 120 mila euro. La domanda è: ma perché deve essere il titolare del sito a prendersi carico di quello che manda un Facebook, Linkedin, Google e i loro derivati sul PC del suo lettore, senza considerare che spesso e volentieri il titolare non usufruisce nemmeno di quei dati raccolti e che, in più, nemmeno vengono archiviati sui propri server ma vanno nei data center dei colossi ? La fattura la mandiamo a loro o al Garante?

Stabilità stabilita

La riforma intrapresa dal Governo Renzi è un obrorio le cui conseguenze saranno ben visibili tra qualche anno. ll problema essenziale della riforma è che punta a creare una “stabilità” artificiosa, senza considerare l’attuale organizzazione della forma-stato italiana e, per di più, senza voler intervenire profondamente su di essa. E’ un accrocchio statistico, come cercare di far quadrare un cerchio. Il proporzionale era una esigenza, non una ideologia Se si pensa che l’organizzazione statale non abbia nulla a che fare con il modo in cui vengono eletti i rappresentanti, significa non capire nulla di come uno stato funzioni. I sistemi elettorali proporzionali erano studiati per bilanciare il centralismo statale con la moltitudine di realtà territoriali in cui era suddivisa l’Italia. Attraverso il proporzionale, quindi, si otteneva una rappresentanza della composizione sociale dello Stato. Questo serviva, di contro, a bilanciare il potere che lo Stato esercitava sui territori garantendo che le decisioni prese fossero “rappresentative” delle differenze sociali ed economiche del Paese. Certo i tempi di “risposta” e gli interventi normativi avevano un iter lungo, ma questo era giustificabile se si pensa che dovendo prendere decisioni per tutto il territorio Italiano si doveva garantire l’equità normativa, ovvero che quanto approvato fosse nell’interesse dell’intera comunità che all’interno del Parlamento aveva espresso i propri candidati. Il maggioritario è stato un essere malformato Con l’arrivo della globalizzazione e la crescita della Comunità Europea era necessario ridurre i tempi decisionali. Per questo motivo, e sull’onda anche degli scandali di tangentopoli, si fece in modo di adottare un sistema maggioritario che avrebbe dovuto consentire la riduzione dei tempi decisionali creando una maggioranza parlamentare in grado di approvare autonomamente leggi e direttive. Questo avrebbe richiesto, tuttavia, una riforma  dello Stato non solo nei suoi aspetti politici (cosa su cui si è sempre puntato in tutte le riforme fino ad oggi adottate), ma anche nella organizzazione territoriale, nei rapporti tra Stato ed Enti Territoriali o, meglio, tra Enti Territoriali e Stato. Infatti se si è mutato il contesto che ha ridotto il peso degli stati nazionali e aumentando i livelli decisionali Europa -> Stato – > Regione -> Provincia – > Comune, allora era necessario rivedere anche i rapporti e gli ambiti di competenze, adottando un modello più federale in grado di chiarire “chi fa che cosa e come”. Cosa che si è tentato di fare e ma con risultati alquanto deludenti. Ma di questo si dirà un po’ più avanti. E’ un legge che va bene in una organizzazione federalista La fonte di ispirazione di queste “riforme” sarebbe il modello anglosassone dove però, l’organizzazione dello stato è completamente differente. Why they will not stop the networked society

What we’re living today is probably the core and hardest point of social change generated by Internet and the so called Social Web. We are in the deep consolidation of the Networked Society in which network technologies are undermining an organizational model based on the centralized power control, in favor of a more distributed power. Despite many governments try in different ways to “arrest” this process through direct or indirect control, we can say that the networked society has passed the point of no-return. In order to understand why It’s impossible to go back, we need to travel through again the path we walked till today. From Globalization to the Information Society The first stage of this change has been realized at the end of ’80 when the Berlin wall’s falling closed the Cold-War and, as we know, this disintegrated the USSR. Falling down the soviet block, also many of threats and limits felt down. In the middle of nineties, WTO born with the intent of supervising and liberalizing international trade. In those years China started to increase its economy and it will has become the largest economy in the world. Europe was moving fast forward to open internal borders and to create the European Union, facilitating people and goods exchange between States. The Globalization was born. In the meanwhile (1993), Internet abandoned the “reasearch” stage becoming the World Wide Web. The major change introduced by this technology was that “borders” would have no more meaning. Now any information can be produced anywhere and used, consumed and spread despite the place and time. It’s a about permanent information stored somewhere and ready to be access by anyone around the world. In nineties we entered completely into the Information Society age. People living in different countries had the opportunity to communicate each other without any limitation. In few years, the number of connected people grown up from 16 million (the 0.4% of world population as in 1995) to 361 million (5.8% of world population as in 2000) to reach about 3 billion in March 2014 (41%) [source: History and Growth of the Internet from 1995 till Today at Internet World Stats]. On one side we had the free circulation of people and goods. On the other side we got the opportunity to have the free circulation of ideas.   Social Media and Internet penetration have a causal and negative impact on corruption: this is the conclusion of the research conducted by Chandan K. LinkedIN pays a lot of attention in enhancing services in order to incentive people to subscribe Premium accounts.In the past days Linkedin has stared to roll out new features aimed to enhance the visibility of the profile. About my summary, for example, LinkedIn suggests to use some keywords such as Media Planning, Marketing Communication, media communication and so on. In choosing which one to include, it must be kept in mind what is your positioning statement and which one of the suggested really fits your skills. Don’t be seducted by the siren inviting you to “appear”.  It’s important but it isn’t enough. You must be consistent with your real competences. Better outstanding in search results When you will appear in search result your profile will outstand better than non premium member. The listing will be twice as big as other results and offer more tidbits from your profile: Past and Current Jobs and the latest education degree. Un marchio se fondato su valori e identità dura, altrimenti deve riciclarsi periodicamente per darsi una rinfrescata. il PCI era la Coca Cola (identità, storia, valori, riconoscimento), dal PDS in poi abbiamo i prodotti civetta.
